Regulation respecting the occupancy and maintenance of buildings

Following its announcement on May 11, 2023, the Draft Regulation respecting the occupancy and maintenance of buildings, replacing the Regulation respecting the maintenance of buildings (07-034) continues the consultation process for adoption in the near future.

It should be noted that these “proposed regulations will have the effect of specifying the scope and main roles of the regulation, namely to prevent the withering away of buildings located on the territory of the City, to protect them against bad weather and to preserve the integrity of their structure. It introduces new definitions of “heritage building”, “exterior elements of a building”, “exterior envelope of a building” and “opening of a building”, and it specifies the general provisions for the good condition of the exterior envelope of a building, its exterior elements, its structural elements, its openings, the check valve and plumbing and heating fixtures.”

At the June 6th public consultation meeting, the City administration explained and defended the changes that will be brought about by the implementation of this new regulation.

It was also confirmed that public buildings will be subject to the same regulations and therefore to the same maintenance obligations. An inventory of the condition of the buildings was requested.

The Association des Propriétaires du Québec (APQ) understands that the City wants to better supervise vacant buildings in order to avoid safety problems, but it regrets that the regulation is not accompanied by assistance to upgrade buildings and thus expand the rental stock.
