Terms of use

The Association of Quebec Landlords (APQ), in partnership with the Regroupement des propriétaires d’habitations locatives (RPHL)-Coalition of Rental Housing Owners (hereinafter “organizations”) will disseminate search notices on the website of each organization in order to retrace former tenants against whom you have obtained a decision that has not been satisfied (hereinafter “search notice”).

CONDITIONS
a) In order to use the search notification service an individual must be a bronze, silver or gold member of the APQ, be resident in Quebec, be an owner or residential rental property manager in Quebec and be eighteen (18) years of age or more (hereinafter the “Participant”).

b) The participant who wishes to publish a search notice shall provide the following information to the organizations: the full name of the person looked for, the reference of the decision as well as the city where the property concerned is located.

c) The judgment against the former tenant must have been rendered within the last 10 years and after 26 November 2009.

d) The participant confirms that the tenant was informed of the proceedings brought or the decision rendered against him.

e) The participant hereby retains the service of the Association of Quebec Landlords in the context of the execution of the decision of the Rental Board or another tribunal.

f) By communicating with the APQ the information mentioned above on a former tenant the participant declares that all information provided is true and that the amounts to be paid under the decision remain unpaid to date.

g) The reply form will be available for a period of thirty (30) days for any person liable to inform the owner and a report will be sent to the participant after this time. This report will not contain any information on informants, unless they agree.

g.0) After the report is sent to the participant, the APQ pledges not to disclose or use personal information about the tenant.
  g.1) The participant agrees to promptly notify the APQ if, during this period, the tenant transmits his details to the participant or if the balance due from the former tenant becomes completely satisfied.

h) The APQ will only disclose on its web page with access reserved for members the following information: the name of the tenant, the city where the property of the participant is located, a link to the unmet decision, the fact that the decision is not satisfied and that the former tenant is untraceable.
  
LIABILITY

a) The Association of Quebec Landlords, the Regroupement des Propriétaires d'Habitations Locatives/Coalition of Rental Housing Owners, their affiliates, subsidiaries, employees, or representatives will not be liable whatsoever for the consequences of the publication of information on its website for the benefit of a participant, or for the accuracy of information obtained by informers. The organizations reserve the right to cancel or suspend the search notices should a virus, bug or other causes beyond their reasonable control contravene with the security or proper administration of the search notices.

b) The organizations reserve the right to amend this Regulation or to terminate at any time the search notices without liability in any manner whatsoever in respect of a participant.

c) If a section from this regulation were to be declared or judged to be illegal, unenforceable or invalid by a competent authority, then this section would be considered as null and void, but no other sections would be affected and would find application within the allowable limits and authorized by law.

d) The participant agrees to carry out the verifications himself in order to ensure the accuracy of the information provided in the report of the APQ and in particular that it is not a namesake, but indeed the tenant cited by the search notice. The participant also agrees, before initiating enforcement proceedings, to attempt to contact the person concerned.

The terms of use are subject to change by the Association of Quebec Landlords. The transmission of an electronic mail by the organization is enough to change the terms of use and their acceptance by the participants.
