The right to be heard must be exercised in good faith; it is not absolute

The party seeking to invoke the principle of the right to a full and complete defence and the right to be heard must demonstrate to the tribunal that they acted in good faith and that they attempted to cooperate with the administration of justice.
Recently a landlady requested termination of the lease and the eviction of a tenant because of his wrongful conduct. The landlady sought an urgent hearing because of the tenant’s aggressive behaviour toward other residents of the building and toward the landlady.
