Residential? Commercial? A bit of both?

In a recent judgment of the Court of Québec, the Court had to analyze the nature of a lease in order to determine which legal regime applied to the contract entered into between the parties. The landlords claimed that the lease was commercial in nature, while the tenant claimed to have rented on a residential basis, which would have the effect of protecting his right to remain in the premises. In this case, a lease had been entered into for a unit in a building where some occupants used their units to live in, and others as workshops.
