Supervision of housing inspectors

On July 19, 2023, the Régie du bâtiment du Québec (RBQ) tabled the draft regulation respecting the supervision of residential building inspectors for inspections for a real-estate transaction (REIBH)(1).

This draft regulation determines the conditions and procedures for recognition to obtain a building inspector certification, which will be issued by the RBQ. The following aspects will now be regulated: the scope of application, the persons targeted by the certification, the qualification process, the conditions for issuing and renewing the certificate, the handling of complaints and the maintenance of skills.

The inspector must carry out his inspection in accordance with the standards developed by the Bureau de normalisation du Québec which defines good practices in this area.

Its entry into force is scheduled for October 1, 2024 with a transitional period of 3 years during which an inspector already on the market can continue to practice without holding a certificate. During this period, inspectors already on the market will be able to qualify for certification by successfully completing refresher training.

This draft regulation follows the two drafts tabled in February 2022, but which were not followed up.
On April 8, 2022, the Association des Propriétaires du Québec filed with the Régie du bâtiment du Québec’s Acting Secretary General and Director of Institutional Affairs its recommendations concerning the following two draft regulations: Draft Regulation respecting the supervision of the inspection of a residential building (REIBH) and Draft Regulation respecting the supervision of the obligation to inspect a residential building (REOIBH).
