The Régie du logement re-iterates that a tenant may waive the public order of protection

In a previous article we discussed a decision of the Régie du logement which recognized that a tenant could give up the public order of protection.(1) The public order of protection prevents the parties from condoning a lease agreement that goes against the sections of the Civil Code of Quebec. The parties could not agree that the landlord would have the right to increase the rent by giving notice to modify the lease, one month before the end of the lease for a one-year lease. Under the Civil Code, the landlord may give this notice, at least three (3) months but not more than six (6) months, before the end of the lease.
